On March 26, CMS published the long-awaited second set of regulations under the physician self-referral law, known as Stark II Law. These rules govern business relationships between referring physicians and the entities with which they have financial relationships. ROBERT A. WADE, Esq., serves as the General Counsel and Organizational Integrity Officer for Saint Joseph Regional Medical Center, Inc., in South Bend, Indiana. Saint Joseph Regional Medical Center, Inc. is an integrated delivery system with hospitals, physician practices, home health agency, laboratory, durable medical equipment, and managed care contracting. He is responsible for overseeing all legal and compliance issues for Saint Joseph Regional Medical Center, Inc., including its Organizational Integrity Program, and is in charge of implementing and documenting compliance with the terms and conditions of SJRMC's Corporate Integrity Agreement, having completed a five-year term. Mr. Wade is the creator of Captain Integrity, a branding and educational tool that has received national recognition and is being marketed for use by other hospitals and health systems. Prior to joining Saint Joseph Regional Medical Center, Inc., Mr. Wade was a partner in the law firm of Baker & Daniels, with whom he still serves as Of Counsel. Mr. Wade has counseled numerous health care clients, including physicians, physician groups, hospitals, ambulatory surgery centers, miscellaneous medical providers, and organizations operating integrated medical services. He has provided health care compliance guidance on a wide range of issues, including the Stark Act, Anti-Kickback Statute, False Claims Act, and the Emergency Medical Treatment and Active Labor Act. Mr. Wade is a noted expert in hospital/physician contracting, including fair market value and commercial reasonableness documentation. Mr. Wade graduated from Bowling Green State University with a B.A. degree, summa cum laude, and from The Ohio State University College of Law with a J.D. degree, summa cum laude. Mr. Wade is admitted to the Indiana Bar, the U.S. District Court for the Southern District of Ohio, the U.S. District Court for the Northern District of Indiana and is a member of the American Health Lawyers Association and the Health Care Compliance Association. He has spoken at numerous regional and national conferences related to healthcare law and compliance. ROBERT G. MALKIN, Esq. is an associate in the Washington, D.C., office of Hogan & Hartson L.L.P. and a member of the firm's Health Group. His clients include hospitals, academic medical centers, manufacturers of pharmaceuticals and medical devices, and high technology health service providers. Mr. Malkin's practice involves health care fraud and abuse matters, including antikickback, false claims, and physician self-referral issues.
