HSA Landmines: Solving Tricky Compliance Problems Before Open Enrollment Begins

With the fall open-enrollment season just a few months away, employers and health plans hoping to sell health savings accounts (HSAs) must focus on one important lesson from the past: To succeed, they better be able to answer the complex questions that employers and employees routinely have about HSAs. More employers than ever are expected to offer HSA-based plans to their employees this fall. But in the three years since the Medicare reform law gave birth to HSAs, health insurers, benefits consultants, brokers and financial firms have done a dismal job of explaining how the plans work, and these failures have had a direct negative impact on enrollment. Unfortunately, few employers are able to answer the often complex problems that their employees have about HSA-based coverage. The result is confusion and ultimately low enrollment in the plans. Many employers don’t fully understand the rules themselves and turn to their health plans, brokers and HSA administrators for help. And when health plans and administrators don’t even have the answers, HSA enrollment is likely to take a  major hit.

First is John Hickman, an employee benefits attorney with Alston & Bird, a nationally recognized expert on HSA compliance. Mr. Hickman will walk you through some of the most common HSA questions that employers and employees face and will offer his assessment of what the IRS is likely to say in its “Grab Bag” HSA guidance, which is due out this summer.

Next, hear about the educational barriers that Deere & Company encountered when it replaced all of its health plans with two HSA-qualified plans for its 18,000 salaried employees. Duane Olson, manager of health and welfare plans, will tell you what it took to win employee support for HSAs and why the effort took 18 months. He’ll also discuss some of the most common questions employees have about the plans — and the answers to them. 

Discover how to neutralize HSA compliance landmines and win support from employees before this fall’s open-enrollment period. Topics addressed include:

  • Rolling funds into an HSA from Individual Retirement Accounts (IRAs), flexible spending accounts (FSAs) and health reimbursement arrangements (HRAs). Should employees be encouraged to transfer dollars from other accounts into their HSA? What are the rules? What is the role of the health plan? The employer? The account administrator or custodian?
  • HSAs and the Employee Retirement Income Security Act (ERISA):
    When does ERISA apply to employee-owned HSAs, and why does it matter? What are the six conditions employers need to satisfy to avoid ERISA applicability?
  • HSA contributions: How should HSA contributions be determined?
    Can employers make larger contributions to lower-paid employees? What about extra contributions for chronically ill employees?
  • HSAs and uncovered expenses: Can employees use HSA dollars to cover services not covered by their health policy (e.g. acupuncture services, chiropractic)? When does the expense count toward the deductible or out-of-pocket maximum?
  • Lines of credit: Can HSA custodians offer an associated line of credit to employees with HSAs? What are the rules and potential violations?
  • Post-enrollment education: What happens after open enrollment? When does the education process end?

JOHN HICKMAN, Esq. is head of Health & Welfare Benefits in the Employee Benefits and Executive Compensation Group at the law firm Alston & Bird, LLP in Atlanta. Mr. Hickman also chairs the Employers Council on Flexible Compensation's technical advisory committee and is an adjunct professor at Emory University School of Law. He is cited in "The Best Lawyers in America" for his health and welfare expertise.

DUANE OLSON is director, Health & Welfare Plans for Deere & Company, with responsibility for Deere’s medical, disability, and life insurance plans. Mr. Olson also supports Deere’s union negotiations. Prior to Deere, he was employed as a physician management consultant and later as a director of fiscal and administrative affairs for a rural hospital.
