Grandfathering Under Health Reform: Strategies for Health Plans and Employers

The Obama administration’s just-released interim final regulations on grandfathering provisions in the health reform law exempt employers’ benefit plans from some mandates. But the regulations do so at a steep price. Grandfathered plans don’t have to comply with some new consumer protections, such as requiring 100% coverage of preventive services. But in return, these employers can make only limited cuts to benefits or increases in out-of-pocket spending. Is it worth it to employers to maintain grandfathered status? How will the new rules, which take effect very soon, apply to collectively bargained employers? How will they interact with existing ERISA rules? Will health plans have to set up dual administrative platforms to serve grandfathered and nongrandfathered plans?

HHS says the grandfathering rules allow employers “to innovate and contain costs by allowing insurers and employers to make routine changes without losing grandfather status.” But under interim final rules published in the June 17 Federal Register, grandfathered plans cannot increase coinsurance percentages, make significant increases in copays or deductibles, or change insurance companies. A variety of other restrictions complicate what at first seemed like a simple exception to reform rules.

Ms. Sheaks is one of Buck’s pre-eminent technical experts and spokespersons regarding the company’s interpretation of and position on regulations, legislation and court decisions. Before joining Buck, she served as legislative counsel at Georgetown University for tax and benefits on its Workplace Flexibility 2010 project. Prior to that, she was a partner at McDermott Will & Emery LLP.

KATHRYN BAKICH is a senior vice president and national director of health care compliance at The Segal Company, based in Washington, D.C. Ms. Bakich has more than 20 years of experience specializing in research and analysis of federal laws and regulations affecting health coverage. She currently serves as Segal’s national director of health care compliance. Ms. Bakich is a member of the Health Technical Issues Taskforce of the American Benefits Council (ABC), the Employers Council on Flexible Compensation (ECFC) Flex Advisory Council and the American Bar Association. She is the author of the Employers’ Guide to HIPAA Privacy Requirements published by Thompson Publishing Group and is a member of the International Foundation’s Government Liaison Committee.
